PTUN Bandung Cancels 2026 West Java UMSK Decision: Governor Ordered to Issue New Decree

Seputarkarawang.com - Karawang, BANDUNG – The Bandung State Administrative Court (PTUN) officially granted the lawsuit regarding the 2026 Regency/City Sectoral Minimum Wage (UMSK) submitted by the Regional Leadership of FSP TSK SPSI West Java Province. In case decision Number 26/G/2026/PTUN.BDG which was read out on Tuesday (30/6/2026), the panel of judges stated that the West Java Governor's Decree regarding the 2026 UMSK was invalid and null and void because it was deemed not to be in line with the recommendations of the local regent and mayor.This legal decision has had a significant impact on wage certainty in a number of industrial areas in West Java. The areas directly affected include Karawang Regency, Cirebon Regency, Subang, Sukabumi, Sumedang, Majalengka, Cianjur, and Garut Regency. The panel of judges ordered the Governor of West Java to immediately revoke the old policy and issue a new Decree (SK) in accordance with the official proposal of the regional government so that workers' normative rights can be fulfilled immediately.In response to the decision, the West Java Provincial Government stated that it would carry out internal coordination before determining the next legal steps. Head of the Law and Human Rights Bureau of the West Java Regional Secretariat, Yogi Gautama Jaelani, revealed that his party is currently waiting for an official copy from the court. Even though there has been no final decision, the government indicated that the option of appeal remains wide open as a formal legal step in accordance with the applicable laws and regulations.

Yogi added that his party needs to respond to this decision very carefully, especially because there are still several similar cases currently ongoing in court. Until now, the provincial government is still mapping the implications of the PTUN decision on wage policy at the regional level. The government's main focus is to ensure that every step taken remains consistent with the national wage policy and maintains the stability of the industrial climate in West Java.On the other hand, the Chairman of the West Java KSPSI DPD, Roy Jinto Ferianto, firmly urged Governor Dedi Mulyadi to comply with the court's decision without resorting to appeal. According to Roy, this decision is a big victory for workers who felt that previous policies did not accommodate real aspirations from the district/city level. He gave an example of the inequality that occurred in the determination of UMSK in the cities of Bekasi and Cimahi, where the figures set were far below those proposed by the local regional heads.This dispute is a real reflection of the challenges in synchronizing wage regulations between the provincial government and regional governments. For workers, UMSK policies that are in accordance with the recommendations of regional heads are considered very crucial for improving welfare in the industrial sector. Now, the public and workers in West Java are waiting for the West Java Governor's definitive steps regarding wage legal certainty which will affect their economic conditions in 2026.
